Agreement

(Scope)

Article 1.

1. Accommodation contracts and related agreements that this hotel concludes with guests shall be in accordance with the provisions of these General Terms and Conditions, and any matters not stipulated in these General Terms and Conditions shall be in accordance with laws and regulations or generally established customs.

2. In the event that this hotel enters into a special agreement, said special agreement shall prevail notwithstanding the provisions of the preceding paragraph to the extent that said agreement does not contravene laws, regulations and customs.

(Application for Lodging Contract)

Article 2.

1. A person who wishes to apply for a lodging contract with this hotel shall provide this hotel with the following information.

  • (1) Name of the guest
  • (2) Date of stay and estimated time of arrival
  • (3) Room rates (in principle, rates are based on the basic room rates in Appendix 1)
  • (4) Other matters deemed necessary by this hotel.

2. In the event that a guest requests during their stay to continue their stay beyond the accommodation date set forth in item 2 of the preceding paragraph, this hotel shall treat the request as an application for a new accommodation contract at the time the request is made.

(Formation of Lodging Contract)

Article 3.

1. The lodging contract shall be deemed concluded when this hotel accepts the application of the preceding article. However, this shall not apply when the hotel proves that it did not give its consent.

2. When a lodging contract is concluded pursuant to the preceding paragraph, an application fee specified by this hotel, as limited to the basic accommodation charge for the period of stay (three days if the period exceeds three days), shall be paid no later than the time specified by this hotel.

3. The application fee shall first be applied to the accommodation charge to be finally paid by the guest, and if a situation arises in which the provisions of Articles 6 and 18 apply, the application fee shall be applied in the order of the penalty charge followed by the compensation charge, and the balance, if any, shall be returned at the time of payment of the charge under the provisions of Article 12.

4. If the application fee set forth in Paragraph 2 is not paid by the date designated by this hotel in accordance with the provisions of the same Paragraph, the accommodation contract shall cease to be in effect. However, this shall be the case only when the hotel has notified the guest of the date of payment of the application fee.

(Special provisions that do not require payment of the application fee)

Article 4.

1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may accept a special agreement not to require the payment of the application fee set forth in the same Paragraph after the contract has been concluded.

2. In the event that this hotel does not request payment of the application fee set forth in paragraph 2 of the preceding article when accepting an application for a lodging contract, or does not specify the date of payment of the application fee, the hotel shall be deemed to have complied with the special agreement set forth in the preceding paragraph.

(Refusal to conclude a lodging contract)

Article 5.

This hotel may refuse the conclusion of an accommodation contract under the following cases

  • (1) When the application for accommodation is not in accordance with these terms and conditions.
  • (2) When there is no room available due to full occupancy.
  • (3) When it is recognized that the person who intends to stay at the hotel is likely to commit an act that is against the provisions of laws and regulations, public order, or acceptable manners and customs.
  • (4) When the person who intends to stay at the hotel is a crime syndicate, a member of a crime syndicate, a person or group related to a crime syndicate, or any other antisocial force (hereinafter referred to as "crime syndicate or other antisocial force").
  • (5) When the person who intends to stay at the hotel is a crime syndicate, or a corporation or other organization whose circumstances and activities are controlled by a member of a crime syndicate.
  • (6) When the person who intends to stay at the hotel is a juridical person and any of its officers falls under the category of crime syndicate.
  • (7) When the person who intends to stay at the hotel speaks or performs any act in a manner that causes significant inconvenience to other guests.
  • (8) When the person who intends to stay at the hotel commits an act of violent demand against the hotel or its employees, or demands a burden exceeding the scope of a reasonable request.
  • (9) When the person who intends to stay at the hotel is clearly infected with a contagious disease.
  • (10) When this hotel is requested to bear more than a reasonable burden for accommodation.
  • (11) When the hotel is unable to accommodate guests due to natural disaster, breakdown of facilities, or other unavoidable reasons. (Right of contract cancellation by guests)

Article 6.

1. Guests may cancel the lodging contract by making a request to this hotel.

2. In the event that the guest cancels the lodging contract in whole or in part for reasons attributable to the guest (except in the event that this hotel has specified a due date for payment of the application fee and requested payment thereof pursuant to the provisions of Article 3, paragraph 2, and the guest cancels the accommodation contract prior to such payment), this hotel shall charge a penalty fee in accordance with the provisions listed in Appendix Table 2. However, in the case where this hotel has concluded the special agreement set forth in Paragraph 1 of Article 4, the obligation to pay a penalty fee when the lodging contract is cancelled by the guest shall only be incurred when this hotel has given notice of said penalty fee to the guest.

3. In the event that the guest fails to arrive at this hotel by 8:00 PM (or when the arrival time has been provided in advance, by 2 hours after that time) on the day of their stay without prior notice, said lodging contract shall be deemed cancelled by the guest and processed accordingly.

(Right of contract cancellation by this hotel)

Article 7.

1. This hotel may cancel the lodging contract under the following cases.

  • (1) When it is determined that the person who intends to stay at the hotel is likely to commit an act that is against the provisions of laws and regulations, the public order, or acceptable manners and customs, or that they have already committed such an act.
  • (2) Anti-social forces such as crime syndicates.
  • (3) Corporations or other organizations whose business activities are controlled by crime syndicates or members of crime syndicates.
  • (4) A juridical person whose officers are members of a crime syndicate.
  • (5) When any speech or act occurs that causes significant inconvenience to other guests.
  • (6) When an act of violent demand against the hotel or its employees is made, or a demand for a burden exceeding the scope of a reasonable request is made.
  • (7) When the guest is clearly infected with a contagious disease.
  • (8) When this hotel is requested to bear more than a reasonable burden for accommodation.
  • (9) When the hotel is unable to accommodate the guest due to a natural disaster or other force majeure.
  • (10) Failure to comply with the the terms of use of this hotel necessary for fire prevention, including smoking in bed, tampering with fire-fighting equipment, and other rules set forth by the hotel.

2. In the event that this hotel cancels the lodging contract based under the provisions of the preceding paragraph, the hotel shall not charge for the lodging services, etc. that the guest has not yet received.

(Lodging registration)

Article 8.

1. Guests shall register the following information at the front desk of this hotel on the day of their stay.

  • (1) Name, age, sex, address, and occupation of the guest
  • (2) Foreign national guests shall also register their nationality, passport number, and place and date of entry
  • (3) Other information deemed necessary by the hotel.

2. When a guest intends to make payment of the charges set forth in Article 12 by an alternative method to cash currency, such as a traveler's check, lodging coupon, or credit card, the guest must specify the method in advance at the time of the registration described in the preceding paragraph.

(Room usage time)

Article 9.

1. Guests may use the rooms of the hotel until 10:00 AM on the morning after check-in. However, the guest may use the room for the full day during consecutive stays with the exception of the arrival and departure days.

2. Notwithstanding the provisions of the preceding paragraph, the Hotel may allow the guest to use the room outside the hours specified in the same paragraph. In that case, the following additional fee shall be charged.

  • (1) 1,000 yen (excluding tax) per hour beyond the specified time.
  • (2) The number of hours that may be extended is limited.

(Compliance with terms of use)

Article 10.

Guests shall comply with the terms of use within the hotel as specified by the hotel and displayed within the hotel.

  • (1) Guests shall not use fire for heating or cooking, or irons for pressing clothing, etc. in the rooms or corridors.
  • (2) Guests shall not smoke in bed or any other location where fires may easily occur.
  • (3) Guests shall not invite third parties to their rooms or allow them to use room facilities or supplies.
  • (4) Guests shall not bring the following items into the hotel.
    • (a) Animals, birds
    • (b) Items that cause a noticeably foul odor
    • (c) Items that easily cause fire or ignite, such as explosives, hazardous chemicals, or volatile oils
    • (d) Guns or swords without a permit
    • (e) A significantly large quantity of goods
  • (5) Guests shall not engage in gambling, any act that disturbs the public morals, or any other acts that may cause inconvenience to other guests within the hotel.
  • (6) Guests shall not utilize the guest rooms or lobby as office space without the permission of this hotel.
  • (7) Guests shall not distribute advertising materials to other guests in the hotel.
  • (8) Guests shall not modify any of the facilities in their guest room without the permission of this hotel.
  • (9) Guests shall not move, modify, or remove any facilities or items belonging to the hotel or use them for any other than their express purpose.
  • (10) Guests shall not enter any part of the facility not open to guests except during emergencies or other unavoidable circumstances.
  • (11) Guests shall not leave their belongings unattended in the hallways or lobby.
  • (12) Guests shall not exit their guest rooms wearing the room slippers or Yukata robe.
  • (13) The hotel will not lend funds for shopping, tickets, taxis, or postage.

(Business hours)

Article 11.

1. The business hours of the primary facilities of this hotel are as follows.

  • (1) Service hours for front desk cashiers:
    • a. Closing: 12:00 PM midnight
    • b. Front desk service: 12:00 PM midnight
  • (2) Food and beverage (facility) service hours:
    • a. Breakfast: 6:30 AM to 8:30 PM at the Restaurant

2. The hours in the preceding paragraph may be changed without notice when necessary or unavoidable. In that case, guests will be informed in an appropriate manner.

(Payment of fees)

Article 12.

1. The breakdown and calculation of the accommodation charges, etc. to be paid by guests are listed in Appendix Table 1.

2. Payment of the accommodation charges, etc., set forth in the preceding paragraph shall be made at the front desk during guest check-in or when requested by this hotel in cash currency or a substitute method approved by this hotel such as traveler’s check, accommodation coupon, or credit card.

3. Once the hotel has provided a guest room to the guest and it is available for use, guests shall be charged for accommodation even when they voluntarily choose not to stay at the hotel.

(Responsibility of this Hotel)

Article 13.

1. In the event that this hotel causes damage to a guest in the performance of the lodging contract and related contracts, or due to non-performance thereof, this hotel shall compensate for said damage. However, this shall not apply when the reason for said damage is not attributable to this hotel.

2. This hotel has been awarded the Certificate of Fireproofing from the Fire and Disaster Management Agency, and subscribes to Hotel Liability Insurance for the unlikely event that a fire occur. (The hotel is insured against fire and other accidents by the Hotel Liability Insurance.)

(Measures when the contracted guest room cannot be provided)

Article 14.

1. In the event that this hotel is unable to provide the contracted guest room to the guest, this hotel shall provide the guest with accommodation at an alternative facility of equivalent or similar criteria to the extent possible with the permission of the guest.

2. When this hotel is unable to provide accommodation at an alternative facility notwithstanding the provisions of the previous paragraph, this hotel shall pay a compensation fee equivalent to the penalty fee to the guest that shall count towards the amount of damages. However, when the reason for inability to provide accommodation cannot be attributed to this hotel, no such compensation shall be made.

(Handling of Stored Materials, etc.)

Article 15.

1. In the event of damage or loss to items, cash, or valuables consigned to the front desk by the guest for storage, this hotel shall compensate for said damages except in the case of force majeure. However, said compensation shall occur in cases in which the type and value of the cash or valuables has been stated by the guest. When no such statement has been made, the damages shall be limited to 100,000 Yen or less.

2. In the event of loss or damage to items, cash, or valuables brought into the hotel by the guest, and not consigned to the front desk for storage, due to the willful misconduct or negligence of this hotel, this hotel shall compensate for said damages. However, when the type and value of said items has not been stated by the guest in advance, the damages paid by this hotel shall be limited to 100,000 Yen.

(Storage of guest baggage and belongings)

Article 16.

1. In the event that the guest's baggage arrives at this hotel prior to their stay, this hotel shall take responsibility for the storage of said baggage only when this hotel has given permission for said storage prior to the arrival of said baggage at the hotel. Said baggage shall then be delivered to the guest during check-in at the front desk.

2. In the event that a guest has left their baggage or personal belongings in this hotel after they have checked out, this hotel shall contact the owner thereof when said owner is identified, and contact them to request instructions. Said items shall be kept in storage for a period of three months from the day of discovery.

3. In the case of the preceding two paragraphs, the responsibility of this hotel for the custody of the baggage or personal belongings of guests shall be in accordance with the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and in the case of the preceding paragraph, in accordance with the provisions of paragraph 2 of the same article.

(Responsibility for Parking)

Article 17.

In the event that a guest makes use of the parking lot provided by this hotel, this hotel shall only be responsible for lending the space and shall not be responsible for the management of the vehicle irrespective of whether the keys thereof have been consigned to this hotel for storage. However, in the event that damage is caused by the intentional or negligent acts of this hotel during the management of the parking lot, the hotel shall be responsible for compensation.

(Guest responsibility)

Article 18.

When this hotel suffers damage due to the willful misconduct or negligence of a guest, the guest shall compensate this hotel for said damage.

Note 1: Basic room rates are based on the rate list posted at the front desk and in the guest rooms.
Note 2: The rate for children applies to elementary school students and younger when sharing a bed with an adult. The fees are 500 Yen (tax not included) for preschoolers (age 0 to 6) and 1,000 Yen (tax not included) for ages 7 and up. The fee for children is 100% of the adult rate when meals and bedding similar to those provided to adults are utilized.
